A trial court has broad discretion in deciding whether to grant a request to change the name of a child. In actions concerning adoption and legitimation, the Court will generally agree to grant a name change. When a woman obtains a divorce, she may decide to change her name back to her maiden name or a previous name. This generally should be done at the time of the divorce. If requested at a later date, the Court may scrutinize the reasons for a name change more closely and require a hearing.

In a name change, the petition must be published in the legal section of the newspaper where the child or adult resides to give individuals an opportunity to object to the change name and to come forth with reasons why the change should not be granted.
